PLEASE READ CAREFULLY. By ordering a Parcelscope Report, you agree to these Terms, including a binding arbitration clause, class action waiver, and a liability cap of $50.

§ 1 · Acceptance of Terms

These Terms form a binding contract between you and Parcelscope LLC ("Parcelscope"), governing your use of all Parcelscope services. By using the Services you agree to these Terms and our Privacy Policy.

§ 2 · Nature of the Service

Parcelscope is not a Phase I Environmental Site Assessment. Not a licensed environmental consultant, attorney, real estate professional, or medical provider. Reports are not professional advice of any kind.

§ 3 · Disclaimer of All Warranties

Services are provided "as is" without any warranties. Parcelscope disclaims all warranties including merchantability, fitness for a particular purpose, accuracy, and completeness. Source data may contain errors or omissions beyond our control.

§ 4 · Limitation of Liability

Parcelscope's total liability for any claim is limited to the amount you paid for the Report, or $50, whichever is less. Parcelscope is not liable for any indirect, consequential, or punitive damages including lost property value, medical expenses, or lost transactions.

§ 5 · No Reliance for Transactional Decisions

Reports are one input among many. You are solely responsible for your own judgment. Consult licensed environmental, legal, real estate, and medical professionals before making purchase decisions.

§ 6 · Scientific Research References

Citations to peer-reviewed studies are for educational context only. Population-level associations do not predict individual health outcomes. Proximity is not equivalent to exposure; exposure is not equivalent to harm.

§ 7 · Source Data Attribution

Parcelscope does not create, verify, or independently investigate Source Data. Claims regarding accuracy must be directed to the source agency (EPA, TDEC, etc.). Each Report includes the last-updated date of each source.

§ 7A · Real Estate Disclosure Obligations

Buyer acknowledges that sharing this Report with sellers, listing agents, or other transaction counterparties may create legal disclosure obligations for those parties under applicable state law, including but not limited to Tennessee's Residential Property Disclosure Act (T.C.A. § 66-5-201 et seq.) and equivalent statutes in other jurisdictions. Once a seller or their agent receives or is made aware of the contents of a Parcelscope Report, they may have a legal duty to disclose material findings to subsequent buyers. Parcelscope makes no representation regarding the disclosure obligations of any party and strongly recommends that all parties consult a licensed real estate attorney regarding their specific obligations before sharing this Report with any transaction counterparty.

§ 7B · Data Currency Limitations

Environmental databases maintained by federal and state agencies are updated on varying schedules outside Parcelscope's control. TDEC Underground Storage Tank data is updated monthly. EPA Envirofacts data is updated on agency-specific schedules ranging from daily to quarterly. OpenStreetMap data reflects community contributions and may not reflect recent changes. Parcelscope reports reflect the state of public databases at the time the report is generated and may not include: (a) releases, spills, or contamination events reported to agencies but not yet reflected in public databases; (b) facilities not yet registered with or known to regulatory agencies; (c) historical contamination predating regulatory records; (d) unreported or undetected contamination; or (e) changes in facility status occurring after the report generation date. Parcelscope expressly disclaims any warranty that its reports reflect current, complete, or accurate environmental conditions at or near the subject property. Users are encouraged to verify findings directly with the applicable agency and to consult a licensed environmental professional for matters requiring current regulatory status.

§ 8 · Indemnification

You agree to defend and hold harmless Parcelscope from claims arising from your use of the Services, violation of these Terms, or sharing of a Report with third parties.

§ 9 · Payment and Refunds

Parcelscope delivers Reports within 24 hours. Refunds are governed by our Refund Policy. Except as stated there, all sales are final. Disagreement with Report contents is not a refund event.

§ 10 · Intellectual Property

All Parcelscope content, templates, and methodologies are proprietary. You receive a limited personal-use license only. You may not resell, redistribute, or use Reports to train AI systems.

§ 11 · Binding Arbitration & Class Action Waiver

All disputes will be resolved by binding individual arbitration (AAA Consumer Rules, Davidson County, TN). You waive the right to a jury trial and to participate in any class action. You may opt out within 30 days by emailing legal@getparcelscope.com.

§ 12 · Governing Law

These Terms are governed by Tennessee law. Disputes not subject to arbitration will be brought in Davidson County, Tennessee courts.
